Welcome to The Art List (“we”, “our”, “us”). By using our website or purchasing any product from us, you agree to the following Terms & Conditions. If you do not agree with these terms, please do not use this website.

1. About Us

The Art List is an online retailer specialising in original artwork, limited collections, fine art prints, canvases, artist trading cards (ACEO), digital artwork and art-related products.

2. Acceptance of These Terms

By accessing our website or placing an order you confirm that:

• You are at least 18 years old or have permission from a parent or guardian.
• You agree to these Terms & Conditions.
• You agree to our Privacy Policy and Returns Policy.

3. Product Information

We make every effort to accurately display colours, sizes and descriptions.

However:

• Colours may vary between monitors and mobile devices.
• Handmade and original artwork may include natural imperfections.
• Dimensions are approximate unless stated otherwise.

Every original artwork is unique.

4. Original Artwork

Where a product is described as an Original Artwork, it means:

• There is only one original.
• It is signed by the artist where stated.
• Ownership transfers once full payment has been received.
• Copyright remains with the artist unless specifically agreed in writing.

5. Fine Art Prints

Fine art prints are produced using premium archival materials.

Unless specifically stated:

• Prints are open edition.
• Frames shown in photographs are for illustration only.
• Minor trimming tolerances may occur during production.

6. ACEO Artist Cards

Our Artist ACEO cards are:

• Original works of art
• Standard ACEO size (64 × 89 mm)
• Signed by artist Chris Berry
• Produced solely as Artist Cards
• Never reproduced in any other format unless specifically stated

Because each card is individually created, slight variations should be expected.

7. Digital Downloads

Digital products are supplied electronically.

Once downloaded, digital products cannot normally be refunded except where required by UK law.

The purchase grants a licence for personal use only.

You may not:

• Resell
• Share
• Redistribute
• Upload elsewhere
• Claim the artwork as your own

Copyright always remains with the artist.

8. Prices

All prices are shown in Pounds Sterling (£).

Prices may change without notice.

Delivery charges are shown during checkout before payment.

9. Payment

We accept payment using the methods displayed during checkout.

Orders are not confirmed until payment has been successfully authorised.

10. Delivery

Delivery times are estimates only.

Although we aim to dispatch quickly, delays caused by couriers, weather or circumstances outside our control cannot be guaranteed against.

Risk passes to the customer once goods have been delivered.

11. Packaging

We take great care packaging every order.

Prints, canvases and original artwork are securely packed using protective materials appropriate to each product to minimise the risk of damage during transit.

12. Damaged Orders

If your order arrives damaged:

• Contact us within 48 hours.
• Include photographs of both the packaging and the item.
• Do not dispose of the packaging until advised.

We will work with you to resolve the issue as quickly as possible.

Nothing in these Terms affects your statutory rights under UK consumer law.

14. Copyright

All artwork, photography, graphics, logos, website content, text and designs remain the intellectual property of Chris Berry and/or The Art List unless otherwise stated.

No content may be copied, reproduced, redistributed or commercially used without written permission.

Purchasing artwork does not transfer copyright.

15. Limited Editions

Where an item is described as a Limited Edition:

• The edition size will be stated.
• Once sold out, no further copies of that edition will be produced.

16. Artist Signatures

Where described, artwork may be hand signed by the artist.

Placement and appearance of signatures may vary slightly between pieces.

17. Promotional Offers

Discount codes:

• Cannot usually be combined.
• May have expiry dates.
• May be withdrawn without notice.

18. Gift Cards

Gift cards:

• Cannot be exchanged for cash.
• Cannot normally be refunded.
• Must be redeemed before any expiry date shown.

19. Website Availability

We aim to keep our website available at all times but cannot guarantee uninterrupted access.

We reserve the right to modify or remove any content without notice.

20. Accuracy of Information

Whilst we strive for accuracy, errors may occasionally occur in pricing, product descriptions or availability.

We reserve the right to correct these errors before accepting an order.

21. Limitation of Liability

To the fullest extent permitted by law, The Art List shall not be liable for indirect or consequential losses arising from the use of this website or products purchased through it.

Nothing in these Terms excludes liability that cannot legally be excluded under UK law.

22. Privacy

Your personal information is handled in accordance with our Privacy Policy.

We never sell customer information.

23. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

24. Changes to These Terms

We may update these Terms & Conditions at any time.

The latest version will always appear on this page.

Continued use of the website indicates acceptance of any changes.
